Per 90 FR 9010(1), effective February 5, 2025, the effective Date of US EPA Final Rule “Implementing Statutory Addition of Certain Per- and Polyfluoroalkyl Substances (PFAS) to Toxics Release Inventory (TRI) Beginning With Reporting Year 2025” dated January 6, 2025 and posted in Federal Register 90 FR 573(2), is delayed until March 21, 2025 pending further Agency (EPA) review, per the requirements of White House Administrative Memorandum “Regulatory Freeze Pending Review” dated January 20, 2025(3). For final rules, the White House memorandum requests the consideration of opening a public comment period, which EPA has elected not to do; citing that such a period is “impracticable, unnecessary and contrary to the public interest. (1)” No additional information is provided by EPA regarding any potential changes to the final rule.
