Privacy Statement

Locus Technologies has created this privacy statement (“Statement”) in order to demonstrate our commitment to customer privacy. Privacy on various Locus Technologies websites is of great importance to us. Because we gather important information from our visitors and customers, we have established this Statement to communicate our information gathering and dissemination practices. We reserve the right to change this Statement and will provide notification of the change at least thirty (30) calendar days prior to the change taking effect.Adherence to Safe Harbor Agreement and Safe Harbor Principles is also a key part of Locus’ privacy policy. Refer to the stated privacy commitment below.


The Locus Cloud Platform

The Locus Cloud Platform allows partners and developers to build applications independent of Locus. Before using these applications, please review the relevant privacy statement and terms of service.


Mobile Applications

When you are using a Locus Mobile application, Locus may obtain information from or access data stored on your device, to provide services related to the relevant mobile application. Locus uses this information to deliver requested application services, to continue to improve our mobile applications, and to facilitate event participation, such as providing event schedules and the opportunity to connect with event attendees. For example, when you are using a Locus mobile application, we may access your camera to allow you to upload photographs to the mobile service; access your calendar, social media, and contact information to allow you to interact with other event attendees; or access the geographic location of your device to enable you to record coordinates of sampling location. Locus may also collect information from your usage of the mobile application to improve sampling events and services, communicate with you about the event and relevant products and services, and for security purposes.

You may configure Locus mobile applications, and this configuration will affect how information from your device is accessed and obtained in the mobile application.

The Locus mobile application uses third party services for enabling easier access to the application, troubleshooting and improvement, and in conjunction with some services mentioned above. These services, such as Google Analytics allow Locus to view aggregated information about end user usage and interactions. Where possible, Locus takes steps to minimize or mask the information sent to third parties (such as encoding the data). These services do not collect any Customer Data as described in the Service privacy statement.


Data Retention

We will retain your personal information only if needed to provide you with services or as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Data entered the Locus Service is retained in accordance with the agreement between the Customer and Locus.


Changes to This Privacy Statement

We reserve the right to change or update this Privacy Statement at any time. Changes to the Privacy Statement will be posted on this website and links to the Privacy Statement will indicate that the statement has been changed or updated. We encourage you to periodically review this Privacy Statement for any changes. For new users, changes or updates are effective upon posting. For existing users, changes or updates are effective 30 days after posting.


Global Privacy Considerations

Personal information collected by Locus may be stored and processed in the United States or in any other country where Locus or its affiliates, subsidiaries, or third-party service providers maintain facilities. When you provide personal information to Locus, you consent to the processing and transfer of your information within the United States and around the world. We follow applicable data protection laws when transferring personal information.


European Privacy Rights

Locus will process your personal information for the legitimate interests of Locus, or, when needed, with your explicit consent. If you have provided consent for the processing of your personal information, you have the right to withdraw consent at any time, which will not affect the lawfulness of the processing before your consent was withdrawn. You have the right to request access to and rectification or erasure of your personal information, as well as the right to restrict processing, object to processing, and under certain circumstances the right to data portability. You have the right to lodge a complaint with a data protection supervisory authority if you believe that we have not complied with the requirements of the EU General Data Protection Regulation regarding your personal information.


APEC Program Statement

Locus privacy practices, described in this Privacy Statement, comply with the Asia-Pacific Economic Cooperation (“APEC”) Cross-Border Privacy Rules (“CBPR”) System. The APEC CBPR system provides a framework for organizations to ensure protection of personal information transferred among participating APEC economies.


EU-U.S. and Swiss-U.S. Privacy Shield Statement

Locus complies with both the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and the United Kingdom to the United States, and from Switzerland to the United States, respectively. Locus has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Statement and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Collected Information

We require customers who register to use the services (“Services”) offered on our Site to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, , and the number of users within the organization that will be using the Services. At the time you express interest in obtaining additional information, or when you register for the service, we may also ask for additional personal information, such as title, department name, fax number, or additional company information, such as annual revenues, number of employees, ERP system used, or industry. Customers may opt out of providing this additional information by not entering it when asked. Customers can update or remove their personal information at any time by logging into the Locus Service and editing their Personal Information within the user information section.

Locus Technologies uses the information that we collect to set up Services for individuals and their organizations. We may also use the information to contact customers to further discuss customer interest in our company, the Services that we provide, and to send information regarding our company or partners, such as promotions and events. Customers are invited to receive an email newsletter by providing an email address. Customer email addresses and any personal customer information will not be distributed or shared with any third parties. Customers can opt out of being contacted by us, or receiving such information from us, at any time by sending an email to support@locustec.com. Separately, customers are also asked to provide an email address when registering for the Service, in order to receive a username and password. We may also email information regarding updates to the Service or company and will send a Customer Newsletter. Again, the email address of a customer will not be distributed or shared, and customers can opt out of receiving any non-essential communication by emailing support@locustec.com at the time it is distributed, or at the time any customer registers for the Service. Except as we explicitly state at the time, we request information, or as provided for in the Locus Technologies Terms of Use, we do not disclose to any third-party the information provided.

All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective customers and to bill for Services. This billing information is not used by Locus Technologies for marketing or promotional purposes. Other third parties, such as content providers, may provide content on the web Site but they are not permitted to collect any information nor does Locus Technologies share any user information with these parties. Customers of the Service will be using the Site to host environmental data and information (“Data”). Locus Technologies will not review, share, distribute, print, or reference any such Data except as provided in the Locus Technologies Terms of Use, or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the Terms of Use, or as may be required by law. Of course, customers are responsible for maintaining the confidentiality and security of their user registration and password.

Locus Technologies may also collect certain information from visitors to and customers of the Site, such as Internet addresses. This information is logged to help diagnose technical problems, and to administer our Site in order to constantly improve the quality of the Service. We may also track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.


Cookies

When you interact with the Locus Technologies Website(s) we strive to make that experience easy and meaningful. When you come to our Web site, our Web server sends a cookie to your computer. Cookies are files that Web browsers place on a computer’s hard drive and are used to tell us whether customers and visitors have visited the Site previously. Standing alone, cookies do not identify you personally. They merely recognize your browser. Unless you choose to identify yourself to Locus Technologies, either by responding to a promotional offer, opening an account, or registering for a 30-day Test Drive, you remain anonymous to Locus Technologies.

Cookies come in two flavors: session and persistent-based. Session cookies exist only during an online session. They disappear from your computer when you close your browser software or turn off your computer. Persistent cookies remain on your computer after you’ve closed your browser or turned off your computer. They include such information as a unique identifier for your browser.

Locus Technologies uses session cookies containing encrypted or encoded information including your username and session ID. This information allows Locus Technologies to process your online transactions and requests. Session cookies help us make sure you are who you say you are after you’ve logged in and are required in order to use the Locus Technologies application.

Locus Technologies uses persistent cookies, which only Locus Technologies can read and use, to identify the fact that you are a Locus Technologies customer or prior Locus Technologies Website visitor (whatever the case may be). We are especially careful about the security and confidentiality of the information stored in persistent cookies. For example, we do not store account numbers or passwords in persistent cookies. Users who disable their Web browsers’ ability to accept cookies will be able to browse our Website but will not be able to successfully use our service.


Third-Party Sites

The Site contains links to other web sites. Locus Technologies is not responsible for the privacy practices or the content of these other web sites. Customers and visitors will need to check the policy statement of these others web sites to understand their policies. Customers and visitors who access a linked site may be disclosing their private information. It is the responsibility of the user to keep such information private and confidential.


Security

Our Site has security measures in place to help protect against the loss, misuse, and alteration of the Data under our control. When our Site is accessed using up to date browsers, Secure Socket Layer (SSL) technology protects information using both server authentication and data encryption to help ensure that Data is safe, secure, and available only to you. Locus Technologies also implements an advanced security method based on dynamic data and encoded session identifications and hosts the Site in a secure server environment that uses a firewall, intrusion detection, and other advanced technology to prevent interference or access from outside intruders. Finally, Locus Technologies provides unique usernames and passwords that must be entered each time a customer logs on. These safeguards help prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of Data.


Opt-Out Policy

Locus Technologies offers its visitors and customers a means to choose how we may use information provided. If, at any time after registering for information or ordering Services, you change your mind about receiving information from us or about sharing your information with third parties, send us a request specifying your new choice. Simply send your request to support@locustec.com.


Correcting & Updating Your Information

If customers need to update or change registration information, they may so by editing the user or organization record within the Locus Service.
